A federal grand jury in the District of Columbia returned an indictment yesterday, which was unsealed today, charging 11 defendants with seditious conspiracy and other crimes in connection with the Jan. 6 breach of the United States Capitol, which disrupted a joint session of the United States Congress that was in the process of ascertaining and counting electoral votes in the presidential election.

Elmer Stewart Rhodes III, 56, of Granbury, Texas, the founder and commander of the Oath Keepers, and Edward Vallejo, 63, of Phoenix, Arizona, are being charged for the first time in connection with events leading up to and including January 6, according to court filings. Vallejo was detained this morning in Phoenix, while Rhodes was caught this morning in Little Elm, Texas.

In addition to Rhodes and Vallejo, nine previously charged defendants are named in the indictment: Thomas Caldwell, 67, of Berryville, Virginia; Joseph Hackett, 51, of Sarasota, Florida; Kenneth Harrelson, 41, of Titusville, Florida; Joshua James, 34, of Arab, Alabama; Kelly Meggs, 52, of Dunnellon, Florida; Roberto Minuta, 37, of Prosper, Texas; David Moerschel They are now facing further accusations for seditious conspiracy and other felonies, in addition to the previous charges.

Eight additional Oath Keepers members, all of whom were previously accused in the inquiry, are still defendants in two other instances. Except for Rhodes and Vallejo, all of the defendants had already been indicted in a superseding indictment. The 11-defendant seditious conspiracy case, a seven-defendant original case, and a third case against one of the previously indicted defendants have essentially been separated into three portions of the superseding indictment.

Charges against James Beeks, 49, of Orlando, Florida; Donovan Crowl, 51, of Cable, Ohio; William Isaacs, 22, of Kissimmee, Florida; Connie Meggs, 60, of Dunnellon, Florida; Sandra Parker, 63, of Morrow, Ohio; Bernie Parker, 71, of Morrow, Ohio; and Laura Steele, 53, of Thomasville, North Carolina, remain pending in one of the related cases, the original superseding indictment. Jonathan Walden, 57, of Birmingham, Alabama, is charged in the other case.

All 19 defendants are charged with corruptly impeding an official procedure in the three indictments. Eighteen of the 19 defendants are charged with conspiracy to impede an official procedure and conspiring to hinder a United States officer from fulfilling a duty, with the exception of Walden. Seditious conspiracy is charged against 11 of the 19 accused. Other charges against several of the accused are pending.

The Oath Keepers, according to the charges, are a big but loosely organised group of people, some of whom are linked to militias. Though anybody may join the Oath Keepers, they specifically target current and former military, law enforcement, and first-responder professionals. Individuals and organisations affiliated with the Oath Keepers were among those who forcefully invaded the Capitol on Jan. 6, 2021.

According to the seditious conspiracy charge, Rhodes planned with his co-defendants and others after the presidential election on Nov. 3, 2020, to obstruct by force the implementation of the laws regulating the transfer of presidential authority by Jan. 20, 2021. The indictment says that beginning in late December 2020, Rhodes and several co-conspirators organised and planned to fly to Washington, D.C., on or around Jan. 6, 2021, the day of the certification of the electoral college vote, using encrypted and secret messaging programmes. Rhodes and a group of accomplices planned to carry guns to the region to aid the operation. In early January 2021, the co-conspirators went across the nation to the Washington, D.C. metropolitan area.

The defendants conspired in a variety of ways, according to the seditious conspiracy indictment, including organising into teams that were ready and willing to use force and transport firearms and ammunition into Washington, D.C.; recruiting members and affiliates to participate in the conspiracy; organising trainings to teach and learn paramilitary combat tactics; and bringing and contributing paramilitary gear, weapons, and supplies – including kniv

As the Joint Session of Congress opened at 1 p.m. on Jan. 6, 2021, a big throng began to assemble outside the Capitol fence. Crowd members finally pushed their way through, over, and over barriers set up by the United States Capitol Police and made their way to the building’s external façade. Crowd members made their way into the Capitol just after 2 p.m. by smashing windows, slamming open doors, and attacking Capitol police and other law enforcement personnel. According to the accusation, Rhodes entered the restricted section of Capitol grounds about this time and told his supporters to meet him there.

According to the indictment, Hackett, Harrelson, Meggs, Moerschel, and Watkins, as well as other Oath Keepers and associates, marched in a “stack” formation up the east steps of the Capitol, joined a crowd, and made their way inside the Capitol at around 2:30 p.m. Later, a second “stack” of Oath Keepers and allies, led by James, Minuta, and Ulrich, penetrated the Capitol grounds, advancing from the west to the east side of the Capitol building, up the east steps, and inside the building.

While some Oath Keepers members and affiliates stormed the Capitol grounds and building, others stayed in quick response force (QRF) units just outside the city. The QRF teams were prepared, according to the indictment, to quickly smuggle guns and other weapons into Washington, D.C., in support of actions intended at using force to prevent the legal transfer of presidential authority. Caldwell and Vallejo are accused of coordinating the squads, according to the indictment.

Seditious conspiracy carries a maximum sentence of 20 years in prison under the law. After considering the US Sentencing Guidelines and other statutory criteria, a federal district court judge will impose any punishment.

The United States Attorney’s Office for the District of Columbia and the Department of Justice’s National Security Division’s Counterterrorism Section are prosecuting this case. The FBI’s Washington Field Office is investigating the matter, with the Dallas and Phoenix Field Offices providing critical assistance. These allegations are the product of extensive collaboration among FBI officers and employees in a variety of locales, including Florida, North Carolina, Ohio, Texas, Arizona, Alabama, and Georgia, among others.

Over 725 people have been detained in virtually all 50 states for offences linked to the breach of the US Capitol in the year since Jan. 6, including over 225 people accused with assaulting or hindering law police. The inquiry is still going on.
