The Voting Rights Act of 1965 (H.R. 4) is proposed legislation that would reinstate and enhance elements of the 1965 Act that were ruled down by the Supreme Court of the United States in Shelby County v. Holder and Brnovich v. Democratic National Committee, respectively, in 2016. It would also revive the Voting Rights Act’s need for pre-clearance for certain changes to state voting procedures. It was reintroduced in the 117th Congress after the late Georgia Representative and voting rights activist John Lewis.

On August 24, 2021, the House of Representatives passed the bill by a vote of 219–212. On November 3, 2021, the legislation failed to get the 60 votes required to invoke cloture, and so did not become law in the Senate.

The Supreme Court struck down a key component of the Voting Rights Act of 1965 in Shelby County v. Holder on June 25, 2013, in a 5–4 ruling (commonly known as the VRA). The court declared VRA Section 4 unconstitutional due to its methodology for evaluating whether states were subject to Section 5’s federal pre-clearance requirement (b). When Section 4(b) was overturned, a new formula was necessary to replace the one that was deemed unconstitutional, preventing the federal pre-clearance requirement in Section 5 from being enforced.

For the purposes of enacting changes to election rules and procedures, qualifying districts were those that had voting tests in place on November 1, 1964, and had fewer than half of the electorate vote in the 1964 presidential election, as specified in Section 4(b) of the VRA.

If new election procedures were to adversely impact the right to vote based on race or other minority status, a three-judge panel of judges in Washington, D.C. or the US Attorney General would have to approve them. Minority turnout in elections rose after the VRA was enacted.

Voting restrictions post-Shelby decision

HB 589, a North Carolina bill, eliminates same-day voter registration, limits early voting, and imposes a rigorous photo identification requirement, among other things. North Carolina admitted in court that counties with a larger population of black inhabitants did not allow early voting on Sundays. HB 589 was declared unconstitutional by the Fourth Circuit Court of Appeals because it was “focused almost surgically at African-Americans.”

The Shelby County v. Holder decision mandated a new formula for the Voting Rights Act, which was the goal of the John Lewis Voting Rights Act.
